Ada Geng, Corporate Counsel, Legal China and APAC at the LEGO Group will present IPR cases in China. Upon the filing of the subject case, Chinese courts have not made any clear decisions on the issue of whether manufacturing and selling products set to be assembled by a buyer should constitute infringement to the design of the assembled product. The win of the LEGO Group of this series of cases represent the first time for the Chinese courts to protect the copyright in the 3D design of assembled products of foreign-invested companies through civil actions and also provide useful reference to foreign-invested entities on using copyright to protect their product designs and creation against non-trademark-counterfeiting "copycat" products in China.
